Booking conditions

Please take a minute to read trough the following booking conditions.

HOW TO BOOK

Complete the application and indemnity forms and return it to MASAZANE EXPEDITIONS by post, e-mail or facsimile together with a NON-REFUNDABLE DEPOSIT OF 50% PER PERSON of the applicable total expedition cost.
A booking will not be considered for acceptance before the prescribed deposit has been paid to MASAZANE EXPEDITIONS. The deposit will be refunded ONLY if MASAZANE EXPEDITIONS cannot accommodate the client on the requested expedition. All persons mentioned on the application form shall be referred to collectively as "the client". The client who accepts a booking does so on behalf of him/herself and all other persons in his/her vehicle. This means that all are bound by the booking conditions as if they had individually made the application themselves.
All bookings are made with MASAZANE EXPEDITIONS and no person or agent has any authority to change any of the conditions on its behalf.

PAYMENT

A non-refundable deposit of 50% per person is required when submitting the completed application and indemnity forms. The deposit is accepted as part of the inclusive cost and will be refunded ONLY if the applicant cannot be accommodated.

The FULL AMOUNT of the expedition cost due by the client to MASAZANE EXPEDITIONS is payable not less than SIX WEEKS PRIOR TO THE DEPARTURE DATE. MASAZANE EXPEDITIONS do not send statements or reminders. If the full amount is not paid in due time, MASAZANE EXPEDITIONS reserves the right to treat the booking as canceled. Late applicants however may join the expedition on an "accommodation and time available" basis.

CANCELLATIONS BY THE CLIENT

Cancellation of a booking must be received in writing from the "Driver" who filled in the application form. A canceled booking is not effective until MASAZANE EXPEDITIONS has received this written cancellation. MASAZANE EXPEDITIONS will retain the full deposit. If the booking is canceled less than forty two days before departure, MASAZANE EXPEDITIONS will retain the full deposit and the client will have to pay a cancellation fee as follows :
42 - 29 days 40% of total cost
28 - 15 days 60% of total cost
14 - 0 days 100% of total cost
If a client does not join the booked expedition or joins it after departure or leaves the expedition before its completion, no refund will be made unless the client previously made an agreement with MASAZANE EXPEDITIONS to only do a portion of the expedition at the time of booking. A written request must accompany the application form. The deposit is not transferable to any other person should the client cancel his/her booking on an expedition.

CODE OF CONDUCT AND AUTHORITY

The decision of the expedition guide will be final in all situations where the safety of the group is endangered. The client will at all times, comply with rules and a reasonable code of conduct (as set out prior to departure) during the expedition and will not in any way constitute a nuisance to the other persons on the expedition.
If the client is a nuisance to the group or if the client commits any contravention of the laws, customs or foreign exchange regulations of a country, MASAZANE EXPEDITIONS may order the client to leave the expedition without right to refund of any monies paid and without any liability to MASAZANE EXPEDITIONS or its employees (hereafter collectively called MASAZANE EXPEDITIONS The client will be obliged to make his/her own way home at his/her own expense and responsibility. In such circumstances MASAZANE EXPEDITIONS will not be liable to make any refund.

ITINERARIES

Itineraries are flexible and will depend on local conditions. MASAZANE EXPEDITIONS will not accept any claims of any nature. This includes consequential damages as a result of any accommodation or other reservations that were made that become unavailable on the expedition. The client indemnifies and holds MASAZANE EXPEDITIONS not responsible for any such claim. Unforeseen circumstances due to road conditions, weather, mechanical breakdown, accident, border closure, political situations, etc. are beyond the control of MASAZANE EXPEDITIONS and can delay and change the itinerary of an expedition.

MASAZANE EXPEDITIONS will not be responsible for any compensation to the client if MASAZANE EXPEDITIONS is forced to cancel or in anyway change the expedition due to war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other external circumstance beyond the control of MASAZANE EXPEDITIONS . MASAZANE EXPEDITIONS will not be held responsible for the cost of flying back home, alternative accommodation, food, personal expenses and all other costs resulting from one or more of the above mentioned uncontrollable factors. MASAZANE EXPEDITIONS will not accept any liability whatsoever.

CANCELLATIONS BY MASAZANE EXPEDITIONS

MASAZANE EXPEDITIONS reserves the right to cancel any expedition prior to departure without prior notification. This covers instances beyond the control of MASAZANE EXPEDITIONS such as the expedition guide is in an accident just previous to the said expedition. All expeditions will also only operate subject to the minimum of participants. Should MASAZANE EXPEDITIONS be forced to cancel an expedition prior to departure then all monies paid to MASAZANE EXPEDITIONS will be refunded in full which shall constitute the full extent of MASAZANE EXPEDITIONS liability to the client and persons under his/her authority.

MASAZANE EXPEDITIONS will not be liable for other costs incurred by the client in preparation of the said expedition. If MASAZANE EXPEDITIONS considers the client as unsuitable for an expedition, MASAZANE EXPEDITIONS may in its absolute discretion decline the client's application.

BAGGAGE

All baggage, personal effects and the client's vehicle are at all times at the client's risk and MASAZANE EXPEDITIONS  cannot accept liability for any loss of baggage, personal effects or the vehicle.

TRAVEL DOCUMENTS

It is the responsibility of the client to ensure that he/she timeously fills in (in full) all the required documentation (e.g. visa application forms) MASAZANE EXPEDITIONS posts to him/her. It is also the responsibility of the client to ensure that these documents are timeously returned to MASAZANE EXPEDITIONS This service can unfortunately only be available to South African passport holders. Non South African citizens will be held completely responsible for all their documentation. MASAZANE EXPEDITIONS cannot be held liable for the failure of this foreign client to obtain the necessary documentation - MASAZANE EXPEDITIONS will however still be able to assist him/her.

It is the responsibility of the client to ensure that he/she is in possession of a valid passport and all the other necessary documentation (e.g. vaccination certificate, vehicle registration forms, etc.) as advised by MASAZANE EXPEDITIONS MASAZANE EXPEDITIONS assists the client at its sole discretion and in so doing, MASAZANE EXPEDITIONS is not assuming any obligation or liability. The client acknowledges that MASAZANE EXPEDITIONS will not be held liable to a refund of the expedition cost or compensation, should the client be refused entry into a country for any reason. MASAZANE EXPEDITIONS cannot take any responsibility for changes in regulations for visas or any particular requirements for visas.

INSURANCE

Comprehensive travel insurance covering cancellation, curtailment, medical emergency travel, personal accident, repatriation expenses, loss of luggage, damage to his/her vehicle, etc. is compulsory for all participants for the full duration of all MASAZANE EXPEDITIONS expeditions. It is the responsibility of the client to ensure that his/her travel insurance is adequate. (Please note that ordinary credit card travel insurance is inadequate for a MASAZANE EXPEDITIONS expedition).

If a client becomes ill, all hospital expenses, doctor's fees and repatriation costs are the responsibility of the client and MASAZANE EXPEDITIONS will not be held liable for any refund of the expedition costs.

INDEMNITY OR LIABILITY

MASAZANE EXPEDITIONS accepts the application from a client on the understanding that the client is aware of the possible risks involved in adventure travel and that the client undertakes an expedition at his/her own risk. All participants must complete and sign an Indemnity Form before joining any expedition. Any person refusing to sign an indemnity form will not be allowed to join the expedition. The client agrees not to hold MASAZANE EXPEDITIONS liable for any and all claims in respect of personal injury or damage to property either direct or consequential that may arise at any stage during the expedition including without limitation those caused by the sole or concurrent negligence of MASAZANE EXPEDITIONS .

The expedition, as arranged by MASAZANE EXPEDITIONS whether in civilized or remote areas, by vehicle, dugout canoe, boat, horseback, ferry, other conveyance or by foot, contains inherent risks of injury, illness, death or loss and damage to property which may be caused by forces of nature, accidents, wild animals, negligence of others, negligence of MASAZANE EXPEDITIONS and other causes known or unknown. Such risks may be present at any time before, during or after the expedition as arranged by MASAZANE EXPEDITIONS and medical services and facilities may not be readily available during the expedition. The client agrees not to sue MASAZANE EXPEDITIONS on account of any losses, claims, costs, liabilities or damages.

HEALTH

The client acknowledges being aware of the proposed itinerary and it is the client's obligation to ensure that he/she is medically fit, in good health and able to embark on an expedition. Any client with a pre-existing medical condition or illness must declare the true nature of his/her condition at the time of application and must make arrangements for the provision of any medicines and/or treatment he/she may require during the expedition. MASAZANE EXPEDITIONS requires a doctor's medical certificate for these clients and clients over 65 years. All information will be handled with the strictest confidence by MASAZANE EXPEDITIONS.

CLAIMS AND COMPLAINTS

If a client has a complaint against MASAZANE EXPEDITIONS the client must first inform the expedition guide whilst on an expedition in order that the expedition guide can attempt to rectify the matter. Should the matter not be rectified whilst on expedition, the client should write to MASAZANE EXPEDITIONS as soon as possible.

The complaint must be received by MASAZANE EXPEDITIONS within 30 days of completion of the expedition so that the complaint can be investigated. Claims will not be considered beyond this time period. MASAZANE EXPEDITIONS will not entertain complaints due to Loss of Enjoyment where the full land arrangements have been provided.

JURISDICTION AND LAW

The client's application and eventual contract with MASAZANE EXPEDITIONS will be interpreted according to the laws of the Republic of South Africa.

INFORMATION

The contents of all brochures, leaflets and advertising are given in good faith by MASAZANE EXPEDITIONS and collated from the latest information available at the time of printing. MASAZANE EXPEDITIONS reserves the right to change itineraries, all prices and services without notice without becoming liable for compensation or refund. Increases in the expedition costs may even be applied after confirmation of application as a result of increased costs to MASAZANE EXPEDITIONS.

PRICE INCREASE

MASAZANE EXPEDITIONS reserves the right to increase their expedition fares due to any increase in fuel costs, park entry fees, fluctuation of exchange rates, etc.

PHOTOGRAPHIC MATERIAL

MASAZANE EXPEDITIONS reserves the right, without obtaining consent or without payment to the client, to use photographs and films taken during the expeditions, for publication in a brochure or other advertising material. The client will not hold MASAZANE EXPEDITIONS liable for permission or payment.

SEVERABILITY

The client must agree not to allege the unenforceability of these conditions or part thereof. In the event that any competent authority finds that any portion of these conditions is unenforceable, the remaining portion will remain in full force and effect. A foregoing obligation from the client is binding.
